FSVP Importer or FDA U.S. Agent: Confirm the Role Before Shipping Noodles

A facility registration contact does not automatically take the FSVP importer role. Confirm the entity, responsibility and any required signed consent before entry.

The U.S. agent listed in a foreign food facility's FDA registration is not automatically the FSVP importer. The same person or organisation can perform both roles, but a registration contact alone does not establish the second responsibility.
For a noodle order, resolve the role before the shipping file is handed to the entry filer. A contact copied from an old registration document may answer the wrong question.

What the two roles mean

FDA's January 2023 FSVP guidance explains that the registration U.S. agent connects FDA with the foreign facility for routine and emergency communications. The FSVP importer carries the applicable supplier-verification responsibilities, including relevant hazard analysis and verification activities.
Normally, the FSVP importer is the U.S. owner or consignee: a U.S. person who owns, has purchased, or has agreed in writing to purchase the food at entry. Where none exists, the foreign owner's or consignee's U.S. agent or representative serves in that role with signed consent. Questions A.2, A.4 and A.16–A.18 in the FDA FSVP guidance explain these distinctions.
FDA also summarises the importer definition and the limits of applicability in its FSVP overview. Start with the actual transaction, rather than choosing whichever American address is easiest to find.

This is a proposed purchasing worksheet, not an FDA form. Add the selected SKU, foreign supplier, shipment reference, confirmation date and responsible reviewer. Keep supporting documents in the order file instead of compressing both roles into a field called “FDA contact.”
An entity name without an explanation of its role should remain an unresolved input. Ask the importer or qualified adviser which facts establish the intended arrangement and which identification details the filer needs.

A name match is not enough

Consider a hypothetical order in which the supplier provides a registration document naming Company A as its U.S. agent. The freight coordinator copies Company A into the FSVP field without contacting it.
The registration document supports a communications role. It does not show that Company A accepted FSVP responsibilities for that order. If the representative route applies because there is no U.S. owner or consignee, obtain and check the signed consent rather than treating the copied name as an appointment.
Conversely, two different company names are not automatically a discrepancy. Record why each appears and ask the parties to confirm their respective roles.

Close the open question before handoff

A useful internal release note records the identified FSVP entity, the person who confirmed the arrangement and the supporting document reference. If the answer remains unclear, mark that part of the shipping handoff pending and assign someone to resolve it.
Do not silently nominate a warehouse, broker or registration agent merely because it already appears elsewhere in the paperwork. Ask whether it is actually the relevant entity for this transaction.
